Collectible Eternity Labs (“CEL,” “Company,” “we,” “our,” or “us”) respects the privacy of our customers, submitters, users, and website visitors. This Privacy Policy explains how we collect, use, process, retain, and disclose information when you visit our website, create an account, submit collectible items for grading or authentication, use CEL registry or identification services, communicate with us, or otherwise interact with CEL and its services.

CEL provides grading, authentication, documentation, encapsulation, registry, identification, archival, provenance, and related services for animation art, comic art, production materials, and other collectible assets. By using our services, you acknowledge the practices described in this Privacy Policy.

3. PHOTOGRAPHY, SCANNING, AND DOCUMENTATION OF SUBMITTED ITEMS

As part of CEL’s grading, authentication, encapsulation, certification, Registry, provenance, security, and documentation processes, CEL may photograph, scan, analyze, and create digital records of collectibles submitted to CEL.

During the grading and authentication process, CEL may create images and records necessary to document the collectible’s condition, identifying characteristics, authenticity, grade, production information, provenance, and other information relevant to CEL’s services.

Following authentication, grading, and encapsulation, CEL may create a digital scan or image of the completed item as encapsulated in the CEL slab. This finished-item scan may display the collectible together with its CEL slab, certification information, grade, label, and other identifying information. The submitter may receive or be provided access to this scan as part of CEL’s services.

CEL may retain scans, photographs, certification information, grades, item descriptions, and other records associated with a graded or authenticated collectible after the physical item has been returned to the submitter. These records may be maintained as part of CEL’s certification database, Registry, population information, provenance records, grading history, fraud-prevention systems, and historical or archival records.

CEL’s creation and retention of these records is intended to document the specific physical collectible and the grading and authentication services performed by CEL. CEL does not claim ownership of the underlying copyright or other third-party intellectual property depicted in a submitted collectible merely because CEL photographs, scans, grades, authenticates, encapsulates, catalogs, or registers the item.

4. ANIMATION ART AND THIRD-PARTY INTELLECTUAL PROPERTY

Collectibles submitted to CEL may depict or incorporate copyrighted characters, artwork, animation imagery, trademarks, franchise materials, or other intellectual property owned by third parties.

Ownership of a physical collectible does not necessarily include ownership of copyrights, trademarks, or other intellectual property embodied in that collectible.

CEL does not claim ownership of underlying third-party copyrights, characters, trademarks, franchises, animation productions, or other intellectual property merely because CEL grades, authenticates, photographs, documents, catalogs, registers, or displays a collectible.

In connection with CEL’s grading, authentication, identification, Registry, provenance, cataloging, and production-history services, CEL may use photographs of submitted items and limited reference imagery or identifying information where reasonably appropriate to document or verify the relationship between a physical production artifact and the production from which it originated.

Such uses may include identifying or documenting an episode, scene, sequence, cut, timestamp, character, production stage, or visual correspondence relevant to the submitted collectible. CEL’s services are intended to provide identification, authentication, grading, documentation, provenance, historical, and collectible-related information and are not intended to provide unrestricted access to copyrighted entertainment content.

5. IMAGE IDENTIFICATION AND MATCHING

CEL may provide technology and services designed to assist in identifying animation production artwork and other collectible materials.

These services may analyze an image of a submitted collectible and compare it with reference information for purposes such as identifying the production, episode, scene, sequence, cut, timestamp, character, or other production information associated with the physical collectible.

CEL may use third-party service providers or technology to perform or assist with certain identification and matching functions. Information or images may be processed by those service providers only as reasonably necessary to provide the applicable CEL service, subject to applicable agreements and law.

6. SUBMITTER-PROVIDED MATERIALS

When an individual or entity submits a collectible, photograph, document, provenance record, image, or other material to CEL (the “Submitter”), the Submitter represents that they lawfully possess the physical collectible or otherwise have authority to submit it to CEL for the requested services.

Submission of a physical collectible does not mean that the Submitter owns the underlying copyright, trademark, character rights, or other intellectual property depicted in or associated with the collectible.

The Submitter authorizes CEL to photograph, scan, examine, analyze, grade, authenticate, encapsulate, catalog, and create and maintain records concerning the submitted collectible as reasonably necessary to provide CEL’s services and maintain CEL’s grading, authentication, certification, Registry, provenance, security, and archival systems.

Additional rights and obligations relating to submitted collectibles and CEL’s services may be governed by CEL’s Terms of Service and applicable submission terms.

7. REGISTRY AND CERTIFICATION RECORDS

CEL may maintain information associated with graded or authenticated collectibles as part of a certification Registry, population database, provenance system, or historical archive. Registry information may include a certification number, grade, description, images, production information, identifying characteristics, and other information relating to the collectible.

Certain Registry information may remain associated with a collectible even if ownership of that collectible later changes. CEL will endeavor to distinguish information relating to the collectible itself from private personal information concerning a Submitter or owner. CEL does not intend to publicly display private contact, billing, payment, or similar personal information as part of a public certification record unless authorized or legally required.

8. PAYMENT PROCESSING

CEL may use third-party payment processors to process payments. Payment card information may be transmitted directly to and processed by those service providers. CEL does not intend to directly store complete payment card numbers when payment information is handled by our payment processor.

Payment processors may independently collect and process information in accordance with their own privacy policies and legal obligations.

9. SHIPPING, INSURANCE, AND DECLARED VALUES

When submitting an item to CEL, Submitters may provide shipping information and a declared value for the collectible. CEL may use or disclose information concerning the Submitter, shipment, collectible, and declared value as reasonably necessary to:

  • Arrange inbound or return shipping
  • Generate shipping labels
  • Obtain or administer shipping or collectible insurance
  • Track shipments
  • Verify delivery
  • Investigate lost or damaged shipments
  • Submit, investigate, or administer insurance claims
  • Prevent fraud or theft
  • Resolve disputes

Shipping carriers, insurance providers, fulfillment providers, and related service providers may receive information necessary to perform their services.

10. HOW WE DISCLOSE INFORMATION

CEL may disclose information to third parties when reasonably necessary to operate our business or provide our services. These parties may include:

  • Payment processors
  • Cloud hosting and data-storage providers
  • Website and software service providers
  • Shipping carriers
  • Insurance providers
  • Fraud-prevention and security providers
  • Analytics providers
  • Authentication, grading, research, or identification technology providers
  • Professional advisers, including attorneys, accountants, and insurers
  • Contractors and other service providers performing services for CEL

We may also disclose information when reasonably necessary to comply with law, legal process, court orders, government requests, insurance requirements, or to investigate fraud, theft, security incidents, disputes, or threats to CEL, our Submitters, or others.

If CEL is involved in a merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar corporate transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law.

CEL does not sell personal information for money in the ordinary course of its business.

11. DATA SECURITY

CEL uses administrative, technical, organizational, and physical safeguards designed to protect personal information and information associated with submitted collectibles. These safeguards may include access restrictions, authentication controls, monitoring, secure systems and service providers, physical security measures, and other measures appropriate to the nature of the information being processed.

However, no website, network, electronic transmission, storage system, or security measure can guarantee absolute security. CEL therefore cannot guarantee that information will never be accessed, disclosed, altered, lost, or destroyed through unauthorized means.

Submitters and account holders are responsible for maintaining the confidentiality of their account credentials and should notify CEL promptly if they believe their account or information has been compromised.

12. DATA RETENTION

CEL retains personal information for as long as reasonably necessary for the purposes for which it was collected, including providing services, maintaining business and transaction records, complying with legal or insurance obligations, resolving disputes, preventing fraud, and enforcing agreements.

Information relating to graded or authenticated collectibles may be retained for longer periods, including indefinitely where reasonably appropriate, to preserve certification integrity, Registry records, population information, provenance, fraud-prevention records, grading history, and historical or archival information.

When personal information is no longer reasonably necessary, CEL may delete, anonymize, aggregate, or otherwise dispose of it consistent with applicable law and CEL’s record-retention practices.

13. COOKIES AND ANALYTICS

CEL and its service providers may use cookies, pixels, local storage, analytics tools, and similar technologies to operate and secure the website, maintain user sessions, remember preferences, understand website performance and usage, prevent fraud, and improve CEL’s services.

Depending on the technologies CEL uses and applicable law, users may be able to manage certain cookies through browser settings, cookie controls, or other mechanisms CEL makes available. Disabling certain cookies may affect website functionality.

14. PRIVACY RIGHTS

Depending on where you reside and applicable law, you may have certain rights concerning your personal information, which may include the right to:

  • Request access to personal information
  • Request correction of inaccurate information
  • Request deletion of certain personal information
  • Obtain information concerning categories of personal information collected or disclosed
  • Request portability of certain information
  • Restrict or object to certain processing where applicable
  • Withdraw consent where processing depends upon consent
  • Opt out of certain uses or disclosures where required by applicable law

These rights are subject to legal exceptions and limitations. For example, CEL may retain information where reasonably necessary to complete transactions, maintain certification and Registry integrity, detect fraud or security incidents, exercise or defend legal claims, comply with legal obligations, or maintain records that CEL is otherwise permitted to retain. CEL may need to verify your identity using information already available to CEL before processing certain privacy requests.

15. CALIFORNIA AND OTHER U.S. STATE PRIVACY RIGHTS

Residents of California and certain other U.S. states may have additional privacy rights under applicable state law. Where applicable, CEL will provide required disclosures and mechanisms for exercising those rights. CEL will not unlawfully discriminate against a consumer for exercising privacy rights provided by applicable law. If CEL’s data practices or applicable legal obligations change, CEL may provide additional state-specific disclosures or notices.

16. CHILDREN’S PRIVACY

CEL’s services are not directed to children under 13, and CEL does not knowingly collect personal information online from children under 13 without legally required authorization. If CEL becomes aware that personal information has been collected from a child in circumstances prohibited by applicable law, CEL will take reasonable steps to address the information as required by law.

17. INTERNATIONAL USERS

CEL is based in the United States. If you access CEL’s services from outside the United States, information may be processed or stored in the United States or other jurisdictions where CEL or its service providers operate. Privacy and data-protection laws in those jurisdictions may differ from those in your country of residence. Where required by applicable law, CEL will use appropriate mechanisms relating to international transfers of personal information.

18. THIRD-PARTY WEBSITES AND SERVICES

CEL’s website or services may contain links to third-party websites, platforms, payment processors, shipping providers, or other services. CEL is not responsible for the privacy, security, or information practices of independent third parties. We encourage users to review the privacy policies of third-party services they use.

19. BUSINESS TRANSFERS

If CEL undergoes or evaluates a merger, acquisition, investment, financing, restructuring, sale of assets, change of control, bankruptcy, or similar transaction, information may be disclosed to advisers, counterparties, investors, lenders, or acquiring entities as reasonably necessary in connection with that transaction. Any subsequent processing of personal information remains subject to applicable law.

20. CHANGES TO THIS PRIVACY POLICY

CEL may update this Privacy Policy from time to time to reflect changes in our services, technology, business practices, or legal requirements. When we make material changes, we may provide notice through the website, account communications, email, or other appropriate means. The effective date appearing at the top of this Privacy Policy identifies when the current version became effective.
